These Terms of Service ("Terms") govern your use of the Santhica mobile application (the "App") provided by Santhica ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Eligibility
Santhica is intended for use by licensed medical professionals, including doctors, physicians, and healthcare practitioners. By using the App, you represent and warrant that you are a qualified medical professional authorized to handle patient medical records in your jurisdiction.
2. Account & Access
You are solely responsible for maintaining the security of your device and account. AI-powered prescription scanning is provided by Santhica — you do not need to provide any third-party API key to use this feature.
3. Permitted Use
You may use Santhica to:
- Capture and digitize handwritten or printed prescriptions, treatment charts and discharge summaries
- Record a consultation by voice and have it transcribed and structured into clinical notes and a prescription
- Create and manage patient records and visit histories
- Review, edit, and store AI-extracted prescription data
- Export records
4. Prohibited Use
You agree not to:
- Use the App for any unlawful purpose or in violation of medical regulations
- Reverse engineer, decompile, or disassemble any part of the App
- Attempt to circumvent security features, including biometric authentication or encryption
- Use the App to process data for which you do not have lawful authority or patient consent
- Share, distribute, or sublicense the App or your access to it
- Use the App as a substitute for professional medical judgment
5. Medical Disclaimer
Santhica is a productivity tool, not a medical device. The AI features — reading clinical documents, and transcribing and structuring voice consultations — are designed to assist you and may produce errors. You are solely responsible for reviewing, verifying and correcting everything they produce before saving it or acting on it. The App does not provide medical advice, diagnosis, or treatment recommendations.
Accuracy varies. For documents it depends on handwriting legibility, image quality, lighting and language; for voice it depends on audio quality, background noise, accent and terminology. Always verify medications, dosages and instructions against the original document or against what was actually said.
6. Data Ownership & Responsibility
You retain full ownership of all patient data entered into or generated by the App. You are solely responsible for ensuring that your use of the App complies with all applicable laws, regulations, and professional standards regarding patient data privacy and medical record-keeping, including but not limited to:
- The Information Technology Act, 2000 (India)
- The Digital Personal Data Protection Act, 2023 (India)
- Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002
- Any other applicable local, state, national, or international regulations
7. Data Security
We implement industry-standard security measures including encryption in transit, an encrypted on-device database, biometric or device-credential locking, access restricted by clinic and role, and logging filtered to exclude identifying information. However, no method of electronic storage is 100% secure. You acknowledge that you use the App at your own risk and are responsible for maintaining the physical security of your device.
8. Third-Party Services
Clinical documents and voice recordings are processed by a third-party AI provider under contract, on a zero-retention basis. We are not responsible for the availability, accuracy or reliability of that provider's service, and any disruption to it may affect document reading and voice transcription in the App.
9. SMS Verification Program
By providing your phone number, you agree to receive a one-time passcode via SMS for account verification. Message frequency varies. Message and data rates may apply. Reply STOP to opt-out, HELP for help. Carriers are not liable for delayed or undelivered messages.
10. Intellectual Property
The Santhica App, including its design, code, branding, logo, and documentation, is the intellectual property of Santhica. These Terms do not grant you any rights to our intellectual property except the limited right to use the App as described herein.
11. Limitation of Liability
To the maximum extent permitted by law, Santhica and its developers shall not be liable for:
- Any errors, inaccuracies, or omissions in AI-extracted prescription data
- Any medical decisions made based on data processed by the App
- Loss of data due to device failure, corruption, or unauthorized access
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Interruptions or failures of third-party services
12. Indemnification
You agree to indemnify and hold harmless Santhica, its developers, officers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable law or regulation.
13. Termination
You may stop using the App at any time by uninstalling it from your device, which will remove all locally stored data. We reserve the right to suspend or terminate access to the App if you violate these Terms or use the App in a manner that could harm us or other users.
14. Updates & Modifications
We may update the App and these Terms from time to time. Continued use of the App after any changes constitutes acceptance of the updated Terms. We will notify users of material changes through the App or via our website.
15. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in India.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
